kidnapping.. call the lawyer now....get a private investigator in case they do leave then you will know where your child has been taken to and you will be able to find them.. if this happens then The otehr parent would hve their rights repealed and lose custody and go to jail for kidnapping What if either parent has court order custody of a child and one of them try leaving the state with the child?
Whoever has legal custody of the kids has to obtain written permission from the other parent and/or the courts. Without it, this move would become spousal kidnapping.
It depends on the state. Here in Louisiana, if both parents are on the birth certificate then they both have equal rights. Google child laws in ur state to c.
Its only an issue if the custody agreement states specifically they may not move out of state. If there is no statement then they are free to live where they want.
you go to court and have them brought back, they need permission from the court to leave the state with the child!
It's kidnapping.
