when they provided the alcohol and the child drove and died?
I have only found criminal negligence which is a felony.
everything else is just misdemeanors. Are there any laws in NY State that would hold a parent responsible for the death of intoxicated child?
I couldn't find any law dealing with this exact situation ... but.
In NY if a bar serves a person to the point of intoxication and they have a crash on the way home, the bar can be held liable for damages, even for damages to the drunk's property and injuries!
The parents would probably also be investigated by Social Services for allowing the minor to get drunk in their presence, they might lose custody of any other children in the home. Are there any laws in NY State that would hold a parent responsible for the death of intoxicated child?
Yes, its called murder two, criminally negligent homicide, endangering the welfare of a minor, and a whole host of other charges.
Yes, everything is illegal in NY.
